How Does Inhaled Insulin Work

There has been lots of research in the field of insulin administration. To keep blood sugar under control insulin is injected. Patients would prefer inhaled insulin to injected insulin especially, when sometimes you have to take up to 6 injections daily. The different targets tried for insulin delivery are through the upper airways i.e. the mouth, the nose, the skin and even as suppositories. Oral delivery is not possible due to the acidity of the stomach and the digestive enzymes of the intestines which prevent the insulin molecules to absorb into the blood. Inhaled insulin can reduce or eliminate the daily insulin injections.

There are several systems in developmental phase by different pharmaceutical firms with products like AerodoseR, AERxTM Diabetes Management System, QdoseR, and ExuberaR.

An advisory panel to the U.S. Food and Drug Administration on September 8th 2005 recommended approval of Exubera an inhaled insulin for adults with type 1 or type 2 diabetes. It is predicted that Pfizer would launch Exubera in late 2006. Exubera is produced by Sanofi-Aventis and Nektar Therapeutics, a California biotechnology firm (formerly Inhale Therapeutic Systems, Inc.) in partnership with Pfizer.

Other inhalable insulins still on human testing are by Indianapolis-based Lilly and Alkermes Inc. and another is by the Danish firm Novo Nordisk and Aradigm. The Lilly-Alkermes inhaler is small enough to fit in the palm of the hand and is breath-activated, but Exubera, a larger device and it relies on compressed air to operate. The Lilly-Alkermes inhaler is expected to reach the market only by 2008.

The delivery of the Exubera is designed in such a way that this should be small enough to get into the lungs and not large enough to be breathed out. Exubera is a rapid-acting, fine dry-powder insulin. The blister packs are loaded into the inhaler device and a trigger is squeezed to disperse the insulin powder into the compartment above. When this is inhaled through the mouth the finely powdered air reaches directly into the lungs. Insulin passes through the alveolar wall found in the lung and enters into the blood circulation. Breathing once or twice would be sufficient. The content in the blister pack is 20 % insulin and 80% is not revealed. The insulin is reported to be stable for 6 to 24 months at room temperature. Proper training will also be given to people on how to use the inhaler properly. Inhaled insulin enters the bloodstream more rapidly than by subcutaneous injection.

Blood sugar control was equivalent when compared to injected regular and inhaled regular insulin. There are some concerns about the long term effects of chronic inhalation of a growth protein into the lungs. Some experts are also worried about people exposed to second hand smoke or lung disease like asthma or emphysema especially since there have been minor reductions in breathing efficiency in some patients and some patients reported coughing.

This inhaler is also effective during cold and upper respiratory infections but may not be that effective during pneumonia. Smokers will be excluded from taking the drug because the cells in the lungs will be already damaged due to smoking and their blood sugar could fall dangerously low with Exubera because they absorb much more inhaled insulin through their lungs than nonsmokers.

Delaying insulin treatment can contribute to higher blood sugar levels, which can lead to complications such as nerve damage, cardiovascular problems, vision loss, and kidney disease.

Database Hacks - Are Banks Required To Notify You?

Ever wonder if banks are required to tell customers when their systems are hacked? You may be shocked to learn that they are not. The only exception to this standard has been database hacks that effect California residents. Companies doing business in California are required to give such notice under the California Security Breach Information Act. The situation is changing quickly on the federal level.

Regulations have been issued by federal finance agencies that now force banks to tell customers when their personal data has been exposed to unauthorized third parties. The regulations are issued pursuant to the Gramm-Leach-Bliley Act, which contains language requiring financial institutions to prevent unauthorized access and use of consumer information.

The new regulations appear to be a reaction to several recent high-profile data leaks. They include incidents such as Bank of America losing data tapes containing information for over 1 million government employees and the breach of databases for LexisNexis and ChoicePoint. It is well known that numerous other banks have also been hacked over the years, but the information has been hushed up.

The new regulations require financial institutions to notify account holders if the institution becomes aware of unauthorized access to sensitive customer information. The directives apply to banks and savings and loan companies, but not credit unions.

There are two serious loopholes in the regulations. First, a financial institution that discovers a database breach must only notify account holders if it is "reasonably possible" that personal details will be misused. Second, the regulations only apply to personal data, not business or commercial accounts.

While these new regulations are a positive step, one could drive a truck through the two loopholes. Determining whether it is reasonably possible that your information will be misused is a vague standard that many financial institutions will use to withhold information. Put bluntly, the notification regulations are gutless.

The best method for keeping an eye on database breaches is to look for stories in the news. Under California law, companies are required to give notice to California residents when breaches occur. If you see a story about your bank giving notice of a hack to California residents, your personal information may have also been exposed. Hackers do not restrict their attacks to California residents.

Piercing the Corporate Veil in Hawaii

Defendants may try to hide assets by placing them in a corporation. In such cases, the attorney is forced to attempt to "pierce the corporate veil". The rule at common law was that, "officers, directors or shareholders of a corporation are not personally liable for the tortuous conduct of the corporation or its other agents, unless there can be found some active or passive participation in such wrongful conduct by such persons." Cahill v. Hawaiian Paradise Park Corp., 56 Haw. 522, 526 (1975). However, in 1973, the Hawaii Supreme Court held that a corporate entity should be disregarded because of circumstances that reveal that the shareholders treated and regarded the corporation as their alter ego. Kahili, Inc. v. Yamamoto, 54 Haw. 267, 271 (1973). This exception has since been called the piercing the corporate veil doctrine because it permits officers, directors, or shareholder to be found personally liable for their actions regardless of the general rule at common law.

There are two overarching elements required by most jurisdictions (including Hawaii) to pierce the corporate veil. Id. First, there must be evidence that an individual in a corporation treated and regarded the corporation as his/her alter ego, and using the corporation as an agency or instrumentality or a conduit through which they were conducted his/her personal business. Kahili, Inc. at 271. Second, the circumstances must indicate that recognition of the fictional corporation would sanction a fraud or promote injustice and inequity. Id.

There are many factors to consider in determining whether the separate personalities of the corporation and the individual no longer exist thus satisfying the first element of piercing the corporate veil. Associated Vendors, Inc. v. Oakland Meat Co., Inc., 26 Cal.Rptr. 806, 813-815 (Cal., 1962) cited by Murdock v. Ventures Trident II (Not Reported in Cal.Rptr.2d) 2003 WL 21246596. Generally, courts in Hawaii have allowed for piercing of the corporate veil when there are enough factors satisfied to show that there were no separate identities between the corporation and an individual. For example, the Hawaii Supreme Court allowed for the piercing of the corporate veil when; (1) two shareholders owned all stock, (2) corporation was undercapitalized, and (3) shareholders' behavior in lease negotiations suggested they were acting for their behalf rather than for the corporation. Kahili, Inc. at 269-272.

As mentioned, it is important to also provide evidence that will convince the court that if it does not pierce the corporate veil, inequity and injustice or fraud will prevail. For example, if there is evidence that an individual was manipulating the corporation to foster her individual interests to the disadvantage of other members of her corporation, then it is only fair that she be found liable (personally) for her actions rather than the corporation. Riddle at 112. Furthermore, the Hawaii Supreme Court held that evidence that an individual used the corporation to commit fraud or another illegal act constitutes promoting inequity and injustice therefore justifies piercing of the corporate veil. Chung v Animal Clinic Inc., 63 Haw. 642, 646-647 (1981). Finally, actual fraud does not need to be shown, just that by piercing of the corporate veil the Court will prevent fraud or injustice. Associated Vendors, Inc. at 813.

The Serious Threats Of Labor-Related Sexual Harassment

The growing number of incidents related to sexual harassments in the workplace is one of the major concerns that the U.S. employment sector is dealing with. Quid Pro Quo is a form of sexual harassment where the guilty party has the authority over his or her victim that enables him or her to demand sexual relationship to the victim in exchange of job favors such as promotions and salary increases. On the other hand, Hostile Work Environment is a type that comes in other ways not attributed to physical contact such as informal jokes or threats which may cause intimidation to the victim and subsequently creates an indecent work environment.
